Florida Republican Rep. Kat Cammack laid out a plan to confront activist judges during her appearance on Fox Business Thursday.

Biden-appointed Judge Ana Reyes on Tuesday blocked President Donald Trump’s executive order banning transgender individuals from serving in the U.S. military, halting its enforcement, pending a final ruling. During an appearance on “The Evening Edit,” Cammack said Congressional action is necessary, adding that the legislative body has neglected its duty to oversee the judiciary, despite having established the lower courts as delineated in Article 2 of the Constitution.

“We have abdicated our authority, even though Article 2 clearly delineates that to the Supreme Court in the judiciary. But it was actually Congress that established the inferior courts, the lower courts and everything about them,” Cammack said. “So we have an obligation to conduct oversight. The last time we took action was back in 1911. So we need to step up as members of Congress and make sure that we don’t have these activist judges that are taking over and pushing for a political agenda.”

Cammack then discussed the Regulations from the Executive In Need of Scrutiny (REINS) Act, a potent legislative measure that she says is aimed at curbing bureaucratic overreach and restoring power to the electorate.

“This is why we need the REINS Act. The REINS Act is the biggest, baddest swamp-draining, empower the people bill out there. We need to get this across the finish line so that it’s back to ‘We the people,’ not the bureaucrats, because nothing scares these swamp creatures more than an informed, motivated, educated and engaged electorate,” Cammack said.

Cammack introduced the REINS Act in 2023, she said, to strengthen congressional oversight and curb executive overreach in federal rulemaking. The bill mandates that both the House and Senate approve any new “major rule” from federal agencies before implementation and allows Congress to reject “nonmajor rules” via a joint resolution.

Cammack also criticized activist judges and framed the situation as a misuse of judicial power for partisan aims.

“Everything that we’re seeing is lawfare. And you heard Press Secretary Leavitt lay it out. Over 60% of the injunctions have been against President Trump. Over 90 of them are from Democrat-appointed judges,” Cammack said. “This is lawfare, pure and simple. And just because you don’t like the outcome of an election doesn’t mean that you can use your power and abuse it for political purposes.”

In a ruling on Tuesday evening, Reyes referenced a quote from the Broadway musical “Hamilton” to overturn the Trump administration’s ban on transgender individuals serving in the military, asserting that “all people are created equal.” Reyes opted for this modern adaptation over the traditional phrase from the Declaration of Independence, emphasizing inclusivity.

Reyes criticized the administration’s policy as being based on speculation and steeped in bias, blocking its implementation. In response, Defense Secretary Pete Hegseth defended the policy, saying that removing left-wing social engineering from the military was essential to focus on combat readiness.
