A lawyer for a man who was arrested after throwing a White Claw at Sen. Ted Cruz (R-Texas) is speaking out on behalf of his client.

Joey Arcidiacono was arrested after throwing the canned beverage at Cruz during the Houston Astros World Series victory parade.

He was reportedly charged with aggravated assault with a deadly weapon and released on $40,000 bond, as CBS Sports reported.

Bill Stradley, who represents Arcidiacono, said in a statement, “Political violence is never acceptable. What happened at the parade was not political violence nor ‘aggravated assault with a deadly weapon.'”

The statement continues, “Fans throw cans to people in championship parades all the time. That is a widely known thing. To get them to chug.”

Concluding the statement, Stradley said, “That was stupid, good fun. This ended up as not fun.”

The Houston Police department tweeted at the time the can “struck the Senator in the chest/neck area. The Senator did not require medical attention.”

HPD made one arrest during today’s victory parade. A male, 33, threw a beer can at U.S. Senator Ted Cruz as the Senator was on a float in the 2400 block of Smith St. The beer can struck the Senator in the chest/neck area. The Senator did not require medical attention.

Cruz expressed his appreciation for law enforcement in a tweet.

“As always I’m thankful for the Houston Police and Capitol Police for their quick action. I’m also thankful that the clown who threw his White Claw had a noodle for an arm,” Cruz tweeted.

The incident came just after Capitol Police Chief Tom Manger issued a call for more resources to protect lawmakers following the attack on Paul Pelosi.

“We believe today’s political climate calls for more resources to provide additional layers of physical security for Members of Congress,” Manger said in a statement.

He added, “This plan would include an emphasis on adding redundancies to the measures that are already in place for Congressional leadership.”
