Ex-AG Eric Holder Says Trump ‘Probably Has to Be Held Accountable’

Former Attorney General Eric Holder says former President Donald Trump should be indicted.

Margaret Brennan, host of “Face the Nation,” noted Sunday there have been critics of Attorney General Merrick Garland who “say that he isn’t being aggressive enough around the prosecutions regarding January the 6th.”

She asked Holder, “Do you think that’s right?”

Holder responded, “No one knows. I have great faith in Merrick and in the people at the Justice Department.”

He added, “We won’t really know how aggressive they have been until they are before a camera in announcing a decision either to indict certain people or not indict certain people.”

Holder went on to predict, at some point, “people at the Justice Department, perhaps that prosecutor in Atlanta, are going to have to make a determination about whether or not they want to indict Donald Trump.”

When asked if he would indict the former president, Holder said, “Well, I think there’s going to be sufficient factual information.”

He explained, “And I think that there’s going to be sufficient proof of intent. And then the question becomes, what’s the impact of, of such an indictment? I’m an institutionalist. My initial thought was not to indict the former president out of concern of what, how divisive it would be. But given what we have learned, I think that he probably has to be held accountable.”

During an interview with NPR in March, Garland commented on the investigation into the January 6 riot.

“We are not avoiding cases that are political or cases that are controversial or sensitive,” Garland said.

He added, “What we are avoiding is making decisions on a political basis, on a partisan basis.”

Garland continued, “We begin with the cases that are right in front of us with the overt actions and then we build from there.”

He explained it is a process “that we will continue to build until we hold everyone accountable who committed criminal acts with respect to Jan. 6.”

Last month, Rep. Liz Cheney (R-Wyo.) was asked whether the January 6 committee has enough evidence to refer Trump for criminal charges.

“It’s absolutely clear that what President Trump was doing — what a number of people around him were doing — that they knew it was unlawful. They did it anyway,” Cheney said.
