Arizona Hits Biden Admin With Lawsuit Over COVID-19 Vaccine Mandate

Arizona Attorney General Mark Brnovich announced the state filed a lawsuit against the Biden administration over its COVID-19 vaccine mandate.

“We have filed a lawsuit today against the unprecedented and unconstitutional power grab by the Biden administration and the federal government. The Biden administration is unconstitutionally trying to mandate vaccines, that may affect hundreds of millions of Americans,” Brnovich said in a statement.

He added, “It’s not only wrong, it’s unconstitutional and as we’ve done on the border crisis, as we’ve pushed back against federal overreach… we will continue to hold the Biden administration accountable and try to stop this federal overreach because we need to protect, not only Arizona, but the entire United States.”

The lawsuit acknowledges “the precise contours of the federal vaccination mandates are not yet clear,” but argues “the violation of the Equal Protection Clause is already evident and egregious.”

It continues, “In a nutshell: unauthorized aliens will not be subject to any vaccination requirements even when released directly into the United States (where most will remain), while roughly a hundred million U.S. citizens will be subject to unprecedented vaccination requirements. This reflects an unmistakable – and unconstitutional – brand of favoritism in favor of unauthorized aliens.”

Texas also has plans to sue the administration, according to the state’s Attorney General Ken Paxton.

“Biden’s new nat’l vaxx mandate on private biz may be the most unconstitutional, illegal thing I’ve ever seen out of any Admin in modern American history. This is an egregious, tyrannical power grab that stands no chance in court,” Paxton said.

He went on, “I’ll be suing this disastrous Admin very soon.”

Biden announced the mandate while delivering the remarks on Friday, as IJR reported.

“Many of us are frustrated with the nearly 80 million Americans who are still not vaccinated, even though the vaccine is safe, effective, and free,” the president said.

He added, “What more do you need to see? We’ve made vaccinations free, safe, and convenient. The vaccine is FDA approved. Over 200 million Americans have gotten at least one shot. We’ve been patient, but our patience is wearing thin, and your refusal has cost all of us.”

Under the mandate, companies with 100 or more employees would be required to mandate their workers to get vaccinated. Federal employees would also be required to get the vaccine or be tested for the virus once a week.
