Border czar Tom Homan appeared on Fox News Monday and criticized a federal judge’s remarks made in the D.C. Court of Appeals.

During a Monday court session, Circuit Judge Patricia Millett, appointed by President Barack Obama, claimed in the D.C. Court of Appeals that Nazis received more favorable treatment during World War II than members of Tren de Aragua (TdA) under the Trump administration, suggesting that Nazis had better chances to contest their removal compared to the alleged gang members. During an appearance on “The Ingraham Angle,” Homan fired back at the judge and said that Millett’s remarks are not only inappropriate but inflammatory.

“Just an example of an activist judge making a comparison. Are you kidding me? It’s a holocaust of Nazis? First of all, what the hell has that got to do with anything? We’re talking about the Alien and Enemies Act. We’re talking about terrorists being deported from the United States,” Homan said.

Homan said that the judge’s comments stirred unnecessary controversy, driven by certain media agendas.

“It’s disgusting she even said that, just try to evoke more, you know, nonsense on the left media, whatever, but it’s a ridiculous statement to make, and, again, it’s another example of an activist judge who doesn’t understand, or probably understands, but wants to push back against the Trump administration who is given a mandate to arrest public safety threats and get them out of the country, especially terrorists,” Homan added.

Homan said he’s confident that the Department of Justice would prevail in defending the act’s application, emphasizing that it aligns with the current administration’s policy priorities.

“I think DOJ will win this case, and we’ll keep doing what we’re doing. You know, the president has made it clear. We’re going to arrest illegal aliens. We’re going to prioritize public safety threats and national security threats. We’re going to continue to do it. We’re going to do it without apologies, especially in sanctuary cities, who let these people hit the streets and create a public safety issue,” Homan said.

President Donald Trump invoked the Alien Enemies Act of 1798 to expedite the deportation of members of TdA. In response, United States District Judge James Boasberg from the District of Columbia halted the deportation process. He ordered the Trump administration to return two aircraft that were en route to El Salvador with gang members on board.

Upon taking office on Jan. 20, Trump had signed several executive orders targeting illegal immigration. These orders included designations of Mexican drug cartels and gangs like TdA and MS-13 as foreign terrorist organizations. Allegations have surfaced that TdA members were involved in taking over apartment complexes in Aurora, Colo., and engaging in kidnapping and murder.

The Border Patrol faced encounters with millions of illegal immigrants under the Biden administration, according to data from U.S. Customs and Border Protection. On Feb. 25, Homeland Security Secretary Kristi Noem reported that Border Patrol agents apprehended only 200 illegal immigrants at the U.S.-Mexico border, marking the lowest single-day total in 15 years.
