Democratic presidential nominee Joe Biden remains committed to not answering questions about whether or not he would support adding more justices to the Supreme Court if he wins the election.

The idea, commonly known as Court packing, has been discussed by some members of the Democratic Party. However, Biden has firmly resisted calls to answer whether he would support such a move.

On Thursday, Biden was asked by reporters if he would support the move, he responded, “You’ll know my opinion on court-packing when the election is over.”

He continued, “It’s a great question, and I don’t blame you for asking it, but you know the moment I answer that question, the headline in every one of your papers will be about that other than focusing on what’s happening now. The election has begun. There’s never been a court appointment once an election has begun.”

During the first presidential debate on Sept. 29, Biden was asked the same question, he responded, “Whatever position I take in that, that will become the issue.”

“The American people should speak. You should go out and vote. You’re in voting now. Vote and let your senators know how strongly you feel. Vote now. Make sure you, in fact, let people know,” he added.

Finally, he said, “I’m not going to answer that question.”

Throughout the campaign, Biden has been pressed on the issue but has refused to answer as gave similar answers.

His running mate, Sen. Kamala Harris (D-Calif.) was also asked about the issue during the first and only vice presidential debate on Wednesday. 

She also dodged the question and instead argued the current Supreme Court vacancy should be held open until after the election, “The American people deserve to make the decision about who will be the next president of the United States, and then that person can select who will serve for a lifetime on the highest court of our land.”

When she was pressed further by Vice President Mike Pence, Harris said, “Do you know that of the 50 people who President Trump nominated to the courts for lifetime appointments, not one is Black?”

“This is what they’ve been doing. You want to talk about packing the courts, let’s have that discussion,” she added.
