The Trump administration is applauding the 5th Circuit Court of Appeals for allowing a portion of military funds to be diverted for the construction of the wall along the U.S.-Mexico border.

On Wednesday, the federal court in New Orleans, Louisiana, lifted an order by a lower court in Texas, to allow $3.6 billion of military construction funds to be used for 127 construction projects at the southern border.

White House spokesperson Stephanie Grisham wrote in a statement that the lower court’s injunction was “illegitimate.” She added that the appeals court’s approval will allow “vital border wall construction to move forward using military construction funds.”

“This is a victory for the rule of law,” Grisham wrote, adding, “We are committed to keeping our borders secure, and we will finish the wall.”

The president also praised the appeals court lifting the lower court’s order, which “[gives] us the go ahead to build one of the largest sections of the desperately needed Southern Border Wall,” he wrote on Twitter early Thursday.

“Entire Wall is under construction or getting ready to start!” Trump added.

Breaking News: The Fifth Circuit Court of Appeals just reversed a lower court decision & gave us the go ahead to build one of the largest sections of the desperately needed Southern Border Wall, Four Billion Dollars. Entire Wall is under construction or getting ready to start!

As CNN reported, the case, however, is still ongoing.

During the 2016 presidential election, Trump made the construction of the border wall along the southern border a signature promise — a promise that has faced obstacles from Democrats.
